In accordance with section 4.1901 of the Federal Acquisition Regulation (FAR), FCI is characterized as information, not intended for public release, furnished by or generated for the Government under a contract for the development or delivery of a product or service to the Government. This definition excludes information disseminated by the Government to the public, such as that found on public websites, or straightforward transactional details required for payment processing.
CUI, on the other hand, encompasses information created or held by the Government, or by an entity on behalf of the Government, which is subject to safeguarding or dissemination controls as dictated by law, regulation, or Government-wide policy.
